Official Rules
HOW TO ENTER
1. No purchase is necessary to enter or win Power 99's Cutest Baby 2020 (the “Contest”).
2. The Contest entry period will begin at 8:00am June 22 14th, 2020 and end at 12:00pm , July 23rd, 2020.
3. Persons eighteen (18) years of age or older wishing to enter this Contest (each an “Entrant”), must go to www.power99fm.com and click on the graphical “Cutest Baby” entry link.
4. The registration/entry process will require you to either log into an existing account, or create a free VIP account.
a. Limit one (1) registered VIP account per e-mail address and limit one (1) contest entry per VIP account. Multiple entries from the same entrant will be discarded. Only the first chronologically qualified entry will be considered. All subsequent entries will be discarded.
b. As part of the entry process, Entrants may be provided with an opportunity to opt-in to receive solicitations from, and/or to become a member/participate in clubs of (i.e., email clubs, text clubs, and rewards programs), the Station; provided, however, agreeing to receive such solicitations and/or accepting such membership is not a condition of entry into this Contest and will not increase your chances of winning.
5. Click on the “Upload Photo” tab and:
a. Submit only one (1) photo of your child, and only your child that meets the requirements in Section 6 below, in either the “.jpeg” or “.jpg” file format (no other formats will be accepted);
b. Enter your child’s first name, your child’s last initial, your child’s age, and the town/city where you live; and
• Entrant represents and warrants that (1) as of the time of entry, the child depicted in the photo has been born on or after January 1st, 2019 at time of entry (the “Age Requirement”), and (2) other than Entrant’s one (1) child, there is no other person visible in the photo at all no matter how far away or obscure.
• Entrant represents and warrants that they are the parent or legal guardian of the child depicted in the photograph.
• Entrant represents and warrants that he/she either owns the rights to, or has otherwise obtained permission to use, the photograph submitted with their entry.
• Entrant represents and warrants to Station that the use and distribution of such photograph will not violate or infringe upon the rights of any third party, including, without limitation, copyrights of others in or to the picture.
• Entrant represents and warrants that he/she authorizes Station to post the photograph on Station’s website and/or on social media sites, or use the photograph in any other manner Station sees fit with no compensation to the Entrant or child.
• Entrant agrees and acknowledges that Station, all Contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors may use the name, image, photograph submission, other entry materials and/or biographical information of the Entrant and/or the Entrant’s child for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this Contest or otherwise without the payment of any additional compensation to the Entrant or to the Entrant’s child.
• By submitting a photograph in a Station Contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable Contest rules prove to be false or inaccurate.
• Entrant understands and agrees that Station shall be the sole and exclusive owner of the photograph submitted, whether or not the photograph is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.
• Entrant acknowledges and agrees that the Contest rules are available to him/her at www.power99fm.com that he/she has had an opportunity to review them before entering this Contest, and agrees to be legally bound by the Contest rules.
6. The photograph submitted as part of Entry for this Contest must (in addition to the other requirements in these Contest rules) satisfy all of the following requirements:
a. For purposes of this Contest, the terms “photo” and “photograph” may be used interchangeably to include, but not be limited to the inclusion of, any image that may be produced by an analog or digital camera, by an optical image scanner (or simply, “scanner”), by means of a “screen dump,” “screen capture,” “screenshot,” or “screengrab,” and/or by the digital manipulation of one or multiple photos such as may be achieved using image editing software.
b. The photo must be uploaded in either the “.jpeg” or “.jpg” file format (no other formats will be accepted), using the method described in Section 5 above.
c. Ultrasound images will not be accepted as an entry for this Contest. The submitted photo must depict a child who has already been born.
d. Only one (1) photo may be submitted for entry in this Contest 1) by any one (1) Entrant who must be both eighteen (18) years of age or older and the parent or legal guardian of the child depicted in the photo, and 2) depicting the Entrant’s one (1) child who must be born on or after January 1st, 2019.
e. If applicable, the child depicted in the photo must be at least covered with a diaper, blanket, or other covering such that the “diaper area” (area that a standard diaper would cover) is not exposed.
f. No person but the one (1) child entered into the Contest may be depicted in the photo (no matter how far away or obscure); provided, however, that Station reserves the right to accept photos that have parts of other people visible that Station deems (in its sole discretion) is not material to the photo and such persons are completely indistinguishable (for example, a leg or finger). Further Station’s decision in this matter is final and not appealable and Station is not obligated to treat every photo identically (for example, Station may decide that in one photo a leg is not material but that a leg is in another photo). Any photo with any other person(s) depicted in it will be ineligible and disqualified, except as otherwise permitted in this Section 6(d).
g. Entrant must exclusively own (or has obtained the a license from the copyright holder to) the copyright in the submitted photo (it cannot be “owned” in any way by any other person or company without obtaining his/her express consent to enter this Contest and allow Station to use the photo as contemplated in the Contest rules).
h. Photo, as well as any comments that may be posted to any photo entries in this Contest, must not contain or convey any content that the Station determines at its sole discretion, subjectively or otherwise: (i) to be indecent, profane, obscene, explicitly sexual, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, libelous, or hateful, (ii) to be racially, ethnically, or otherwise offensive or objectionable, (iii) to encourage unlawful behavior, (iv) to contain, depict, or otherwise infringe upon the brand name(s), copyright(s), trademark(s), servicemark(s), tradename(s), logo(s), or any other intellectual property that may belong to a third party, or (v) to disclose any detailed personal, physical, contact, or otherwise confidential information that may belong to a third party. The foregoing is not intended to require Station to disqualify entrants who, in Station’s sole discretion, appear to be innocently wearing clothing or are in areas that just happen to contain third party logo(s) or mark(s). Further, Station may, but is not obligated to pixilate/cover any trademark(s), servicemark(s), tradename(s), and/or copyrighted materials in Station’s sole discretion. Station shall not be required to make the same determination based on the foregoing for every photo and may treat each photo entry differently, in its sole discretion, even if the problematic content is similar.
These rules and regulations shall apply to all on-line contests (the “Contest”) unless stipulated otherwise, and where alternate rules and regulations are made available to the public. If there are any discrepancies between these rules and regulations and any other rules and regulations posted for any particular Contest (the “Alternate Rules”), such discrepancy shall be resolved in favour of the Alternate Rules.
Eligibility:
The Contest is open to legal residents of Canada who have reached the age of majority in the province in which they reside. No person who is employed by the JPBGLP or its affiliate companies and no family member of such employee shall be entitled to enter the Contest.
In certain cases, minors under the age of majority will be permitted to enter the Contest and be eligible to win the prize. In no case, however will a minor be declared a winner without the prior written consent and release of liability of the minor’s parent or legal guardian.
How to Enter
There is no purchase necessary to enter the Contest.
Enter the contest by clicking on the “Enter Contest Here” button on the web-site.
Winners will be chosen by random draw, unless specified otherwise eg: Special On-line Contest.
Upon being declared a potential winner, the caller will be required to answer, unaided a time-limited mathematical skill testing question. Upon correctly answering that question, the potential winner will be declared the winner.
Value
No Prize may be exchanged for cash, sold or transferred to any third party.
Odds of Winning
The odds of winning the Contest are dependant on the number of entrants attempting to enter the Contest at any given time.
Liability
The winner acknowledges that the collection or use of the prize may be inherently dangerous and agrees to release and hold harmless the JPBGLP for any and all damages he may incur through entering the Contest or through the collection or use of the prize. The winner also agrees to sign a standard release and waiver of liability prior to claiming the prize which will generally be provided.
Each entrant and any potential or declared winner releases the JPBGLP, their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the contest or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the release form. The guest of a winner (or a parent or legal guardian in the case of a minor) will also have to sign such a declaration to that effect in the release form, failing which they will not be able to take part in the prize.
Facebook Contests
All Facebook contests held by CFMM are in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the contest, you are acknowledging this rule and completely releasing Facebook for any and all damages you may incur through entering the Contest or through the collection or use of the prize.
Release of Privacy Rights
By entering this contest, each declared winner consents to the contest organizers, their representatives to use, at their sole discretion and if required, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant.
General
Prize winners shall be responsible for all costs and expenses not explicitly stated to form part of the prize, including but not limited to taxes, fees, gratuities, insurance, or travel to and from the airport where a prize includes travel.
Where the Prize includes travel, the Prize winner must ensure that he and his companion have all the necessary travel documents required to travel to the destination on the dates specified in the prize description.
Prior to receiving the Prize, the Prize winner shall sign a standard release and liability waiver absolving the JPBGLP of all its obligations under the Contest and accepting the Prize as awarded as full and final satisfaction of all items owed to him by the JPBGLP.
The JPBGLP may at its sole discretion substitute a prize or a portion thereof with an alternate prize of equal or greater value. Notwithstanding the foregoing, the JPBGLP shall not be responsible to substitute a prize or portion thereof where such prize can not be redeemed due to factors beyond its reasonable control.
In the event it is impossible, difficult and/or more costly for the JPBGLP to award a prize (or part of a prize) as described in these contest rules, the contest organizers reserve the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the value of the prize (or of the part of the prize) in cash.
The JPBGLP reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the contest as provided in these contest rules.
All decisions of the JPBGLP or those of their representatives regarding this contest are final and binding.
The winner also agrees to abide by the rules and regulations for pick up which can be found at www.power99fm.com.
By entering the Contest, all persons are deemed to have read and to have accepted these rules and regulations.
